Why do you need a Will and Power of Attorney?
A Will is a legal document that outlines how you wish your assets and belongings are distributed after your death. In Scotland, having a valid Will ensures your estate is administered according to your wishes, helping to avoid delays, disputes, or unintended outcomes under the laws of intestacy.A Power of Attorney is a separate legal document that allows you to appoint someone you trust to make decisions on your behalf if you become unable to do so yourself, whether due to illness, accident, or incapacity. This can cover financial matters, property, and personal welfare.
Having both a Will and a Power of Attorney in place offers peace of mind and protection – ensuring your affairs are managed the way you want, by the people you choose, at a time when it matters the most.

Office of Public Guardian Fee
£96
The statutory fee charged by the Office of the Public Guardian (Scotland) is £96 for registering a Power of Attorney under Section 19 of the Adults with Incapacity (Scotland) Act 2000.
It ensures your document is officially recognised and legally enforceable across Scotland.
- Applies to Continuing and/or Welfare Powers of Attorney
- Required for legal registration with the Public Guardian
- Separate from our drafting service fee
- One fee per person per Power of Attorney
We handle the registration process for you, giving you a complete and worry-free experience from start to finish.
Independent Solicitor Capacity Meeting
£50
This service includes a consultation with an independent Scottish solicitor to assess and confirm mental capacity for Power of Attorney documentation. It supports legal compliance by ensuring the person granting authority fully understands their decisions.
- Required for many Power of Attorney applications
- Conducted by a qualified independent solicitor
- Verification of mental capacity for legal purposes
- Includes completion of Schedule 1 certificate
We coordinate this essential step to ensure your documentation meets legal standards with ease and professionalism.
